Perhaps the most difficult and emotional task is to decide with whom the children will live and, for the non-residential spouse, the details of contact. It must be remembered that both spouses remain as parents to the children and the children have a right to know each of their parents. Peaceful negations between the parents will usually result in the best long term arrangements which are in the best interests of the children. It must be remembered that the interests of the children are paramount. I can arrange for informal conferences to assist in this process.
If agreement cannot be reached than you can apply to the Court for suitable orders. The orders which a Court can make are:
- Residence – a decision as to with whom the children reside
- Contact - arrangements for contact between the children and the non-residential parent
- Specific Issues – orders which deal with matters such as medical or educational issues
