Criminal Law Drink Driving
Drink Driving
This offence is known as Prescribed Concentration of Alcohol (PCA). It is a provision of the Road Transport (Safety and Traffic) Act that it is an offence to drive or have control of a motor vehicle where there is a prescribed concentration of alcohol in that person’s blood. For most people the legal limit is 0.05 grams per 100 millitres of blood. For some people such as young drivers this can be as low as 0.00
If you are arrested as being over the PCA you will normally be placed on bail and given a date to appear in a named Local Court where on attendance you will plead either “guilty” or “not guilty”
It is advisable to have legal representation when you appear in Court.
